Dedicated Servers Terms and Conditions

This Dedicated Server Agreement governs the terms and conditions under which you purchase a dedicated server from STS Host and Tech INC. It provides a summary of customer rights and responsibilities.

Introduction

This is STS Host and Tech INC’s Dedicated Server Agreement that governs the terms and conditions under which the customer purchases a new dedicated server from STS Host and Tech INC. The terms “we”, “us” or “our” refer to STS Host and Tech INC. The terms “You”, “Your”, “he” and “she” refer to you as the customer, or any agent, employee, servant or person authorized to act on your behalf.

PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY BEFORE USING THE SITE OR SIGNING UP FOR ANY SERVICE THAT STS HOST AND TECH INC OFFERS.

Service Delivery

We will inform the client regarding the availability of the dedicated server through email when the dedicated server becomes available. The invoicing for the dedicated server starts effectively on the launch date. Our company makes sure that the server is available for the client within 7 days of payment. However, some dedicated products may require more than 7 days for delivery — please visit the product page for details.

If we fail to provide the client with the requested services within 7 days, after such deadline expires, the customer has the complete authority to cancel the purchase order and demand a refund.

In the case of the client renting out the dedicated server to a third party: the dedicated server remains the property of STS Host and Tech INC; the IP address will remain static for all rented servers; the customer is the administrator of the server and is liable to install all software and applications on the server. Every reasonable effort is made by us to maintain the uninterrupted operation of your services.

Customer’s Obligations

The Responsibility of Security and Protection

  1. You take full responsibility for choosing highly secure passwords and for maintaining their security. You assume all risks about the consequences resulting from the loss of such password(s).
  2. The security of your services is your full responsibility. Make sure you apply security tools like firewalls and anti-virus, update the system periodically, back up your data, and secure all your software.
  3. We can proceed with the immediate suspension (without notice) of any server on which paid or free public proxies, IRC, VPN, TOR, etc. are offered, when STS Host and Tech INC has knowledge of misuse, fraudulent or unlawful use.
  4. In order to maintain the security level of the customer’s server and all servers on the hosting platform, we agree to notify the customer of the availability of updates for applications where security flaws have been reported. If these application updates are not carried out at STS Host and Tech INC’s request, we reserve the right to interrupt the server’s connection to the internet.

The Responsibility of Your Activities

Your activities are your full responsibility. You assume all risks resulting from your use of:

  • The products, websites hosted, and services on your dedicated server.
  • The content of information transmitted, posted, or collected, used, and updated.
  • All files, including address files.
  • The shared hosting services and all contents of your websites.

About Rights

  1. We have the right to check the customer’s compliance with the provisions regarding use of the service. STS Host and Tech INC reserves the right to suspend the service without prior notice if the customer fails to comply with our terms and conditions of service and, generally, with all laws and regulations in force, as well as with rights of third parties.
  2. STS Host and Tech INC has the right to suspend the Services (without prior notification) if the customer is in breach of any terms and conditions, any applicable laws and regulations in force, or any applicable third-party rights.
  3. You do not have the right to request any reimbursement, replacement, or compensation from us for damages or failures to the server from the use by your staff or members, or by any other person to whom you have provided your password(s). You are fully responsible for the rented server.

The Customer Shall Agree and Acknowledge

  • They are subject to the laws applicable in the territory on which the equipment are installed.
  • STS Host and Tech INC has the right to suspend the service if it is used for a prohibited activity at the place of physical location of the equipment provided by us.
  • The same right applies to IP addresses. The customer acknowledges STS Host and Tech INC’s right to suspend an IP if it is used for a prohibited activity at the place of registration of the IP. We may suspend all IP addresses of the customer registered in the same location.

Other Responsibilities

  • You must refrain from any breach or attempted breach activities (such as port scanning, sniffing, spoofing) while using the server. In such cases, you shall not be entitled to any reimbursement of amounts already paid.
  • You shall pay for any license or right to use, either provided by us or with a third party, failing which STS Host and Tech INC reserves the right to suspend the service without prior notice.

DDoS Attack Protection Terms

We offer customers protection against any type of DDoS attacks including Denial of Service (DoS) or Distributed Denial of Service (DDoS). Depending on the nature and complexity of this protection service, you agree that:

  • STS Host and Tech INC does not subject itself to an obligation of means.
  • We may not detect the attack by the tools in place, and the tools developed do not prevent the operation of the service from being interrupted.

In the case of other computer attacks such as SQL injection, brute-force, or security vulnerability exploitation, it is your sole responsibility to protect the server against those kinds of attacks.

Prohibited Activities on Dedicated Servers

If any of the following (including but not limited to) services or activities are found on the server, we will proceed with immediate suspension (without notice):

  1. Any forgery, prohibited, or fraudulent activity that is considered illegal in the area.
  2. Any activity being carried on through the IP where the activity seems to be prohibited at the place of IP registration.
  3. Traffic Exchange, HitLeap, Automated Browsing, Crawlers, iMacros, AutoSurf, etc.
  4. Email Spamming of any type.
  5. IRC servers.
  6. Pirated Content / Warez / Illegal Downloads or Uploads.
  7. IP Scanners / Port Scanning / Brute-force Programs.
  8. Bank Debentures / Bank Debenture Trading Programs.
  9. Virtual Currency Mining (including but not limited to Bitcoin).
  10. Lottery / Gambling Sites.
  11. Sites promoting hacking or illegal activities.
  12. Hosting of abusive content (Copyright violations).
  13. Fraudulent / Phishing / Replica Sites.
  14. MUDs / RPGs / PBBGs.
  15. TeamSpeak / Mumble.
  16. Crypto Mining.
  17. Public Proxies / Public VPNs / TOR Exit / Anonymizers.
  18. DDoS-prone applications, booters, flood scripts, or IP spoofing.
  19. Cracking tools / illegal software key generators.

Refund Policy

None of the dedicated server module and product fees are refundable, unless in the event of failure to deliver by STS Host and Tech INC as described in the Service Delivery section of these terms.

Support

Due to the specificity of the service, customers are fully in charge of the management and maintenance of their dedicated server. However, if they need assistance or want to leave this task to our highly-qualified administrators department, they can avail of our Managed Support service available on request.

The 24-hour, 7 days a week support offered by STS Host and Tech INC relates to hardware and network support only.
