Introduction
This is STS Host and Tech INC’s Web Hosting Agreement that governs the terms and conditions under which the customer purchases a new web hosting plan from STS Host and Tech INC. The terms “we”, “us” or “our” refer to STS Host and Tech INC. The terms “You”, “Your”, “he” and “she” refer to you as the customer, or any agent, employee, servant or person authorized to act on your behalf.
PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY BEFORE USING THE SITE OR SIGNING UP FOR ANY SERVICE THAT STS HOST AND TECH INC OFFERS.
Service Delivery
We shall inform the customer by automatic email when the web hosting services become available. Our company shall not be liable in the event the email does not reach the customer’s email address. Invoicing shall begin on the effective date of the online launching of the web hosting services. The services shall become available within a few minutes; rarely, for some technical issues, it may take a maximum of 2 to 3 hours to deliver.
In the event of failure of service delivery on time, the customer has the right to cancel the purchase order and receive a full refund. Every reasonable effort is made by us to maintain the uninterrupted operation of your services.
Obligations and Liabilities
The Responsibility of Security and Protection
- You take full responsibility for choosing highly secure passwords and for maintaining their security. You assume all risks about the consequences resulting from the loss of such password(s).
- The security of your services is your full responsibility. Make sure you apply security tools like firewalls and anti-virus, update the system periodically, back up your data, and secure all your software.
The Responsibility of Your Activities
Your activities are your full responsibility. You assume all risks resulting from your use of:
- The products, websites hosted, and services on your hosting account.
- The content of information transmitted, posted, or collected, used, and updated.
- All files, including address files.
- The shared hosting services and all contents of your websites.
The Customer Shall Agree and Acknowledge
- They are subject to the laws applicable in the territory on which the equipment are installed.
- STS Host and Tech INC has the right to suspend the service if it is used for a prohibited activity at the place of physical location of the equipment provided by us.
- The same right applies to IP addresses, and the customer acknowledges our right to suspend an IP if it is used for a prohibited activity at the place of registration of the IP. We may suspend all IP addresses of the customer registered in the same location.
The Customer with Shared Hosting and/or Reseller Account Acknowledges
- Not to use over 25% of system resources, including but not limited to Memory, CPU, Disk, Network, and Bandwidth capacity, for longer than 90 seconds in any consecutive 6-hour period.
- Not to execute long-running, stand-alone, unattended server-side processes, bots or daemons.
- Not to run cron entries or scheduled tasks with intervals of less than 15 minutes.
- Not to run any type of web spiders or indexers.
- Not to use the hosting as a backup/storage device.
- Not to store over 100,000 files.
- Not to run any MySQL or MS SQL queries longer than 15 seconds.
- Not to store a large number of media files (audio, video, etc.).
- Not to send over 100 messages per hour per user and/or 300 messages per hour for a domain name, or to receive a high volume of emails in any given period of time.
- As Shared Hosting, not to purchase/use a Dedicated IP Address without installing an SSL Certificate.
- As Reseller Hosting, not to purchase/use a Dedicated IP Address without installing an SSL Certificate, and to ensure customers comply with the same rule.
- Not to use more than 2 GB size per database.
Data Backup
- We make disaster backups for shared and reseller server data. No guarantees are made as to the integrity of these backups.
- Backups are made for server restoration purposes only and belong to us.
- It is your responsibility to maintain local copies of your web contents and information.
- A “Backup/Restore” feature is included with each hosting plan and you can use this tool to back up your files.
- If loss of data occurs due to an error on our part, STS Host and Tech INC will attempt to recover the data at no charge to the client.
- If data loss occurs due to client negligence or action, we will attempt to recover the data from the most recent archive for a $100.00 USD fee.
About Rights
- We reserve the right to undertake checks to ensure that the Services are being used by the Customer in accordance with this agreement.
- STS Host and Tech INC has the right to suspend the Services (without prior notification) if the Customer is in breach of any terms and conditions, any applicable laws and regulations in force, or any applicable third-party rights.
- You shall pay for any license or right to use, either provided by us or with a third party, failing which STS Host and Tech INC reserves the right to suspend the service without prior notice.
Outgoing Traffic Terms
No Spam or Fraudulent Emails: We do not tolerate the transmission of spam emails. We monitor all traffic to and from our web servers for indications of spamming. When we detect this, we shall inform the customer by email and block the server’s SMTP port. If the customer resolves the issue, they may request unblocking of the SMTP port by emailing us.
Any new email identified as spam will entail a new blocking of the SMTP port for a longer period to be determined at our reasonable discretion. If we block the SMTP port three times because of spam or traffic violation, STS Host and Tech INC reserves the right to deny any new request for the unlocking of the SMTP port.
DDoS Attack Protection Terms
STS Host and Tech INC offers customers protection against any type of DDoS attacks including Denial of Service (DoS) or Distributed Denial of Service (DDoS). Depending on the nature and complexity of this protection service, you agree that:
- STS Host and Tech INC does not subject itself to an obligation of means.
- We may not detect the attack by the tools in place, and the tools developed do not prevent the operation of the service from being interrupted.
In the case of other computer attacks such as SQL injection, brute-force, or security vulnerability exploitation, it is your sole responsibility to protect the server against those kinds of attacks.
Prohibited Activities on Web Hosting
STS Host and Tech INC will proceed with immediate suspension (without notice) if any of the following (including but not limited to) services or activities are found on the server:
- IRC servers.
- Traffic Exchange, HitLeap, Automated Browsing, Crawlers, iMacros, AutoSurf, etc.
- Pirated Content / Warez / Illegal Downloads or Uploads.
- IP Scanners / Port Scanning / Brute-force Programs.
- Email Spamming of any type.
- Investment Sites (HYIP, FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme, etc.).
- Lottery / Gambling Sites.
- MUDs / RPGs / PBBGs.
- Sites promoting hacking or illegal activities.
- Bank Debentures / Bank Debenture Trading Programs.
- Fraudulent / Phishing / Replica Sites.
- Public Proxies / Public VPNs / TOR Exit / Anonymizers.
- TeamSpeak / Mumble.
- Virtual Currency Mining (including but not limited to Bitcoin).
- DDoS-prone applications, booters, flood scripts, or IP spoofing.
- Open DNS resolvers / recursors.
- Cracking tools / illegal software key generators.
- Public Game Servers.
- File hosting services.
- Cardsharing (CCCam or equivalent).
- Adult hosting websites or any related content.
- Making any files or links that breach third-party intellectual property rights publicly available.
- P2P or file-sharing networks.
- Hosting of abusive content (Copyright violations).
Refund Policy
If the customer purchased Shared Hosting or Reseller Hosting with a contract period of more than 30 days, STS Host and Tech INC shall guarantee a 30-day money-back guarantee if the customer is not satisfied with the services. The refund excludes IP address fees, any purchased license, and SSL certificates, even if those are included free in the package.
Support
Due to the specificity of the service, customers are fully in charge of the management and maintenance of their web hosting. However, if they need assistance or want to leave this task to our highly-qualified administrators department, they can avail of our Managed Support service available on request.
The 24-hour, 7 days a week support offered by STS Host and Tech INC relates to hardware and network support only.
